EFF Files "Heavily-Redacted" Court Papers Friday; May Affect Hundreds of Cases

Defense Attorneys Claim ‘Key Evidence’ in Undermining Copyright Lawsuits
New evidence surfaced Friday in the Righthaven LLC lawsuits that attorneys say could undermine Righthaven’s entire copyright infringement lawsuit campaign over Las Vegas Review-Journal stories.
Attorneys for the online freedom of speech group the Electronic Frontier Foundation (EFF) filed heavily-redacted court papers in Las Vegas on Friday asking the federal court for permission to use the evidence against Righthaven and Stephens Media LLC.
Stephens Media owns the Review-Journal and a Stephens Media affiliate co-owns Righthaven.

  1. This is certainly good news. Cheers to the EFF. Let's just hope their case is solid, which I feel it is. As a Righthaven victim, I can see another countersuit from myself and others here in the near future.

  3. I wonder if Stephens Media "knowingly" agreed to Righthaven's sham copyright assignments? I'm sure they had fine attorneys who reviewed the agreement, but were they top rate IP attorneys with extensive knowledge of the inner workings of copyright assignments? In other words, did they know that what Gibson presented was a sham? Gibson likely sold the idea of Righthaven to the Review-Journal and Stephens Media, and he probably could due to their frustration and anger over the industry's inability to leverage their content into stronger revenues. Wouldn't it be ironic if Stevens Media or the R-J could turn around and blame (or sue) Righthaven for falsely representing the copyright assignment arrangement? After all, they'll need to blame someone when this is all over. I also wonder if Denver Post attorneys are busy shredding or amending related documents this weekend.

  4. Stephens Media IS Righthaven. They cannot turn around and sue themselves. Plus if these allegations are correct this is not something that will just effect these lawsuits. If Righthaven and these news empires colluded to make sham copyright assignments to use in lawsuits then this is fraud on a massive scale. In fact if these are sham assignments then people are going to jail and entire media empires are going to be taken down. This may turn out to be the biggest scandal to ever hit the newspaper industry.

  6. Why can't we get ALL of the Righthaven victims together for one huge class action lawsuit? I suppose we need to wait and see what happens with this new evidence from the EFF. It looks as if Righthaven, Stephens Media, Gibson and others could be named in such an action.
